One factor that may have to be considered in some divorces is that of spousal support, which is also commonly referred to as alimony. Typically, alimony is only ordered when one party makes a significantly higher amount of income than the other party. After a divorce, the less monied spouse may not be able to financially support themselves and therefore, may want to request spousal support. In New Jersey, there are four types of alimony.
- Open durational alimony has recently replaced what was once referred to as permanent alimony. This is reserved for couples who were married for more than 20 years. It does not require the court to set an end date for alimony termination. However, the court can suspend, modify, or terminate the obligation at a later date if there has been a significant change in circumstance.
- Limited durational alimony is an option for couples who were married less than 20 years. In New Jersey, the alimony obligation period should not be longer than the length of the marriage.
- Rehabilitative alimony exists to aid the party who deferred their career to benefit the family in obtaining the education or training necessary to become financially independent.
- Reimbursement alimony exists to pay back one spouse who financially supported the other while they pursued their education or training during the marriage.
