No Fault Divorce in New Jersey

When a marriage in New Jersey is on the rocks and it seems as though it will never be what it used to be, it may be time for the couple to consider getting a divorce. There are several options when it comes to getting divorced in New Jersey. At the very beginning of the divorce process, before it even truly starts, the individual will have to file the Complaint for Divorce, which has a few parts to it.

In the Complaint for Divorce, the individual filing will have to fulfill the residency requirement as well as cite grounds for divorce. The individual has the option to cite no-fault grounds for divorce, which simply means that the reason they are filing is that there have been irreconcilable differences for quite some time or the couple has been separated for at least 18 months. However, if the person wishes to cite fault grounds, they have the option to cite one of the following grounds:

  • Abandonment
  • Addiction
  • Extreme cruelty
  • Deviant sexual conduct
  • Incarceration
  • Institutionalization
