Contested Divorce

When spouses begin a divorce on poor terms, they may need to go through litigation to accomplish what they need to. This tends to happen when spouses cite fault grounds for their divorce and hold the other responsible for the end of their marriage. This may be due to adultery, habits of intoxication, abuse, deseration, or a prison sentence of 5+ years. Spouses who are unable to reach agreements regarding the terms of their divorce may need a judge to do so for them. This is known as a contested divorce.

Uncontested Divorce

When spouses are able to reach agreements regarding their marital issues, this is known as an uncontested divorce. This may be if no-fault grounds is cited and neither party is looking to hold the other responsible for the breakdown of the marriage. When this happens, they do not necessarily have to divorce in the courtroom. There are other options available, such as:

  • Mediated Divorce: This method allows couples to reach agreements regarding the terms of their divorce through negotiations with the help of an unbiased third party. The mediator guides them towards agreements that work for both parties. When they are done, the mediator can present the arrangements to court to be approved.
  • Collaborative Divorce: This method takes place through a series of four-way meetings in which spouses are joined by their attorneys to figure out the future of their marital issues.
  • Arbitration: This method also involves a third party who acts as a judge instead of a mediator. They make all the final decisions relating to the couple’s marital issues.
